Has anyone been following the Harry Potter copyright infringement case in (I think) NYC? After making millions off a story that started on a napkin, the HP author wants to prevent one of her biggest fans from publishing a encyclopedia based on the Harry Potter books. The fan even broke down crying on the witness stand. Seems like Harry Potter author is being unnecessairly greedy. What do you think? |

I agree that billionaire Rowling is making much ado about nothing. What this fan did will not diminish the legacy or popularity of the Harry Potter books in any way. And certain money shouldn't be a factor in this case. Fame and fortune seem to sometimes make people eccentric and paranoid. IMO |

A copyright holder has to defend each infringement of his or her work or the copyright is deemed lost. How does Rowling know that this is just a fan and not some sharp ass business man trying to cop a fast buck? Rowling's lawyers have probably told her that if she let this slide, everybody and they mama would be doing Harry Potter stuff and not paying her. I would also bet they have gone to the fan and tried to work something out and the fan went crazy. If they say cease and desist you got to do that or cut them in or get some permission or something. Nope. Don't think so. People should make up their own stuff. |

But if "people should make up their own shyt" there would never be any encyclopedias, Google, YouTube or anything else. Even the record companies, the Kings of Greed, learned after Napster and the other online sharing sites, you gotta give a lil to get a lot. Why can't an ordinary Joe can't make a buck (or million) off of someone else's idea? This is America, for goodness sake. |

Why can't an ordinary Joe can't make a buck (or million) off of someone else's idea? This is America, for goodness sake. (I will explain it again. Once Rowling allows that, not only is there nothing stopping every Tom Dick and Harry from ripping her off--including possibly copying her books word for word and slapping their names on them--if she fails to defend the copyright she loses the protection. I bet when you write or create something you will change your tune. |

Even the record companies, the Kings of Greed, learned after Napster and the other online sharing sites, you gotta give a lil to get a lot. Agree 100%. The rules have changed with new media ,and the record, movie, book, and other companies will have to keep up. I think she would have done better to figure out a way to make this work--to allow some degree of independent "fan fiction" and other end user-generated spin offs without causing undue risk to her brand. |

^Yvettep, you said it much better than I. The writer she is suing is considered a Harry Potter expert and was hired to consult on Harry Potter movies. Why do celebrities go out of their way to antognize their fans? Rowlings claims she doesn't want HP enthusiasts to have to sell out $$ to buy a HP encylopedia. But she sure didn't mind readers breaking off $$ for her Harry Potter books. My prediction: Harry Potter loses this case. |

Yvettep and Robynmarie: So I assume that I can come in your houses, eat your food, drink your liquor, bring my hoes in your bedroom and screw em in your bed and you have no problem with it. Yeah right. That is the same thing this gy is doing with Rowling's property. If you have been followng the downloading cases the music companies have been suing people and winning and folks and doing that stuff--at least downloading and selling it. Record companies sue, yet folks continue to file share--more than ever, and industry profits continue to decline. Despite a few high profile lawsuit "wins," the record companies are losing and will continue to lose this battle. As will the movie studios. As will publishing companies/authors. Anyone paying attention can see where the winds are blowing here. |
