Negroes, I know it is difficult to get your facts straight, since after all that involves thinkin' an dat am de white folks' game, but please try harder in the future. He did not have or use a cell phone and the attempt was blocked, since it was a collect call and you have to accept the charge. http://www.ajc.com/metro/content/metro/atlanta/stories/2006/09/29/0930metnichols .html Likely witness alleges recent call by Nichols By RHONDA COOK The Atlanta Journal-Constitution Published on: 09/30/06 Accused killer Brian Nichols tried to make a collect call Thursday from the county jail to the woman he was on trial for raping when he made his deadly escape March 11, 2005, from the Fulton County Courthouse, according to an affidavit. In court papers filed Friday, District Attorney Paul Howard said prosecutors were concerned that Nichols was trying "to terrorize or intimidate" witnesses expected to testify against him in his death penalty trial. Howard asked that Nichols be barred from future use of the telephone and having any contact with witnesses or other inmates. The prosecutor said there have been reports that Nichols had use of a cellphone and had plotted an escape with another prisoner. The reported escape attempt will be discussed during a hearing next month. The district attorney also asked that Fulton Sheriff Myron Freeman come to court to explain what he is doing to keep Nichols secure in the jail. In a sworn statement that accompanied Howard's request for an emergency hearing, Nichols' alleged rape victim said he tried to call her at her home about 9:30 Thursday night. The woman said Nichols knew her telephone number because it was unchanged from a time when they dated. "Once I picked up the phone, I immediately heard an automated voice recording stating that 'This is a collect call from ...' The name that was announced on the recording was 'Brian,' " she wrote in her statement. "I recognized the voice as that of my ex-boyfriend, Brian Nichols. I have known Brian Nichols since December 1996. I have heard his voice numerous times and recognize it." The recording gave instructions for accepting the call and for blocking future calls from the jail. "Since I did not choose an option, the recording and Brian's recorded name repeated three times before it automatically disconnected," she said. Her statement said she telephoned her parents, a "few close friends" and one of the prosecutors in the murder case to tell them about the call. "I felt the call was inappropriate and was shocked that I received it. It made me uneasy," she wrote. "Brian Nichols indicated to me on the date he raped me, Aug. 19, 2004, that if I turned him in that he would haunt me and my family. I felt the phone call was a continuation of this type of threatening mentality." The woman's mother also provided an affidavit for Howard's motion. The mother wrote that she wanted her daughter to return to her parents' home. "I feared that Brian had escaped and that he would come after my daughter ... " Howard's motion said the Thursday night call was confirmed through jail records and a recording the alleged rape victim made. Nichols is being held in a seventh-floor cellblock dedicated to high-risk inmates. He is supposed to be closely monitored. But, like other inmates, Nichols has had telephone privileges. All calls from the jail are collect, even those to local numbers. Court officials and defense attorney Gary Parker confirmed that the phone call would be discussed during a motions hearing already planned for Monday. Howard was unavailable for comment Friday evening. The sheriff's spokeswoman declined to comment on whether additional security measures were being taken. Nichols is accused of killing Judge Rowland Barnes, court reporter Julie Ann Brandau and Fulton deputy Sgt. Hoyt Teasley during his escape. In addition, Nichols is accused of killing federal agent David Wilhelm in Buckhead. Nichols has pleaded not guilty. His death penalty trial is scheduled to begin in January. Sponsored Links

A Negro charged with breaking jail and killing a judge and a Federal Agent anc a court reporter and a Deputy getting special privileges. What planet are you living on? They are beating Black men to death in there for looking funny, or having another prisoner do it. The only reason they haven't done it to this dude is because they know they are going to snuff him and they are going to make him crawl before they do. |

Well, you'd have to know Fulton County jail system. First of all, the MAJORITY of the people who run it, including the sherrif, are black people. They're hardly going to be racist against him even if they hate him for other reasons. Second, this is the same prison system that had a problem inmates coming and going as they pleased (yep, some inmates just WALKED out), and with a well known rapper (T.I., I believe) just walking in with a camera crew and shooting a music video. It's hard to know what they allow and disallow. |

I know in any jail system you ain't got to come out of there alive even if you go in for parking tickets and nobody will cry if he "commits suicide" by hanging himself with his hands tied behind his back as they have been wont to do here in Ol' Mizzou. |
